Back to Grimm, whether they were on or off-duty doesn't matter. A threat was being posed so they felt bringing out their guns was required.
First, Nick didn't save the day. Hank drew his gun and failed, then Nick made things even worse by drawing his gun and failing.
Second, there's not a lot of sense to your reasoning. Nick felt Juliette was such a threat that he and Hank brought their guns *just in case*, but doesn't bother to warn Monroe and Rosalee to arm themselves, just in case?

In the world of a big city idiot, Blutbad meaning (blood bath) are supposed to read minds and homicide detectives are supposed to foresee the future? But did Hank and Nick fail? They did pull out their guns yet they didn't shoot anyone. The only person in that shop to shoot a gun was Juliette. She used her powers to force Nick to shoot at Monroe. Just more facts only a big city idiot would deny what Juliette did. In the end, nobody died. To the part of the world seeing a half filled glass of water as Half Full instead of half empty, that was a win, not a failure.
All this off duty, on duty crap. I believe they were on duty. One of the ingredients to make the potion was Adalind's mother. Her corpse had to be exhumed. To get that done, Sean Renard probably had to get involved as the Police Captain. As we can clearly see him standing at the grave site when they dug her up. So, at this point of the game, since he is almost a quasi-member of the gang he probably assigned them or gave them permission to be involved in the delivery of the potion while on duty.
As for the legal debate, that was a tactic used by the Juliette sympathizers when cornered about her involvement in a criminal act. They deflected into legal mambo-jumbo to try to come up with excuse for Juliette's hand having the blood of Kelly and the neighbors on her hands.
