They pretty much do, unless there's a court action like a custody dispute, or CPS has some kind of action going on. If the other parent objects, he or she can go to court over it and it's likely the court would at least order the parent who turned the child over to someone else to produce that child while arguments were heard or be held in contempt. And in the real-world example you cite, that's exactly what the other parent did.
